THE NITTY GRITTY

 

Payments

To secure your spot on the tour, we take a 10% non-refundable deposit.

Your final tour balance payment (the 90% remainder) is due 60 days before your tour is scheduled to start. If your payment is not received 60 days before tour start we reserve the right to treat the reservation as cancelled and you will forfeit your deposit.


CANCELLATION POLICY

As you can imagine tours like this are complex and involve many bookings and provisioning of gear. Where possible if you need to cancel, the best route is a reschedule for a date that works better for you, but we understand that life happens to everyone too. Some important things to note:

If you cancel your tour your deposit is NON-REFUNDABLE

If cancelling after you’ve made your 90% remainder payment:

  1. More than 21 days prior to departure 50% will be refunded.

  2. Between 21 and 14 days prior to departure date 25% will be refunded.

  3. Less than 14 days prior to departure - No refund.


Mechanical Issues

In the event of a mechanical issue that has not been caused by rider negligence we will undertake all possible effort to provide a repair or replacement bike.


ABANDONMENT

As you can imagine tours like this are complex and involve many bookings and provisioning of gear. If you fail to join the tour or leave the tour prior to completion no refunds can be given.


MOTORBIKE SECURITY DEPOSIT

The renter of the hire motorcycle is liable for ALL damages to the bike.

We require a Damage Security deposit of $1800 bond to be made before departure and you must have a current, valid motorcycle licence.

This money is refundable upon the safe return of your hire motorcycle provided no major damage caused by theft, accident or negligence has occurred to the motorcycle.

If damage and repair costs amount to less than your deposit then the difference between the repairs cost and the deposit will be refunded.

If the damages are over the $1800, then you will be liable to pay the additional costs.

Repair costs also include the transportation and handling costs, if any, of an accident-damaged motorcycle to the final destination of the motorcycle tour.

All prices are in Australian (AUD) Dollars and include 10% GST.

The Damage Security Deposit is processed on your credit card, Visa/Mastercard or provided as cash, upon commencement of the tour.


ASSUMPTION OF RISK. RELEASE AND WAIVER.

Each participant of a tour operated by Ultimate Cape Escape (UCE) is required to accept and sign a release and waiver, assumption of risk and indemnity agreement form of rights before tour starts.

UCE cannot accept any tour participant without a duly signed release and waiver, assumption of risk and indemnity agreement form.

By booking a guided tour you agree that you understand and agree to the indemnity release details summarised below, which the actual indemnity release form will be signed on the morning of the tour, which is between you and UCE.

You agree that you are participating entirely at your own risk and that you, your successors, executors and administrators will release, indemnify and not instigate any claim, demand or expense against UCE for any personal injury, loss of life or damage to personal property suffered during or subsequent to events on the tour.

The participant must acknowledge that any road whether sealed or unsealed, or any other venue upon which you travel, may have muddy, sandy or rocky surfaces with defects either hidden or exposed as is the nature of some roads.

You must agree to obey and observe all rules and directions given during a tour, whether given in writing or verbally by UCE and the UCE has the right to exclude you from any tour for non-adherence to any rule or direction given.

You must accept that you are permitted to take part in a tour on condition that you ride safely with due care and regard for other people and property.

You must acknowledge that motorcycle riding, can be dangerous and that participation in a tour organised and promoted by UCE may expose you to the possibility of injury or death and further, you must acknowledge that the way other people may ride, drive or act is outside the control of UCE.

You must acknowledge that there may be no, or inadequate facilities for treatment or transport of participants if participants are injured.

You agree that you understand that travel insurance to cover all forms of personal injury, repatriation or costs in the event of death is essential and it is your responsibility to ensure you have appropriate cover.

You agree to wear appropriate motorcycle safety equipment at all times and that you are medically fit to undertake a motorcycle tour.

You must agree that you have read and understand the summary indemnity release, full version signed upon morning of departure of tour, and agree that participation in a guided tour is entirely at your own risk.


SAFETY

Our first concern is getting you out there for a safe adventure and returning you home in one piece. Our guides have appropriate first aid certification and carry first aid supplies at all times.

We also carry a satphone and EPIRB for use in an emergency situation.

You will be given a daily briefing on the conditions you’ll be riding in, discussing the itinerary of that day’s ride.

We’re going to have a great time, but we still need to keep you safe. Before we kick off we’ll give you a reminder about riding safe, local speed limits, obeying signage and other things that will help keep you and others safe.

All local rule rules MUST be complied with. It is your responsibility to stick to rules and your responsibility if you come afoul of the law.

Helmets are absolutely mandatory when riding in Australia. No exceptions.

You must hold a valid motorcycle license (this will need to be sighted and recorded prior to departure.

You must also fully understand and accept that motorcycling is a potentially dangerous activity. To participate in the tour must must be aware and fully accept the risks involved with riding motorcycles, especially off-road.

As a rider you’re responsible for being aware of the traffic, general road conditions, changing weather and other motorcyclists.

You are also responsible for keeping your motorcycle under control, selecting appropriate speeds and adhering to state claws.

You are solely responsible for your your bike and the way you ride it. You are responsible for your speed and riding style. This applies even when riding in convoy with other riders.

All participants ride at your own risk and are legally liable for injury or damage to other road users (including fellow participants in UCE tours). This applies when you are being led by UCE staff or otherwise.

You must follow the directions of the UCE motorcycle leader at all times.

If you ride in a manner that is unsafe to yourself or others, or act in an offensive manner the UCE tour leader reserves the right to terminate your motorcycle tour, thereby forfeiting the balance of the motorcycle tour.


LUGGAGE/BAGGAGE

Ultimate Cape Escape will undertake our best efforts to protect and secure your luggage/baggage at all times. You will be in riding gear all day and space is minimal. There are washing facilities provided along the tour.


INSURANCE

Ultimate Cape Escape strongly recommends all riders take out travel insurance which specifically covers off-road motorcycle riding.

Look for travel insurance that covers in case of an accident and that in the event you have to cancel the tour if your personal circumstances change.

UCE, its Agents, Assigns and Contractors accept no responsibility for a customer’s failure to arrange appropriate cover.


REQUIRED ITEMS

  1. You must bring your current valid motorcycle license (motorcycle learner’s permit is also acceptable).

  2. A credit card with a capacity of $1800 for your security deposit.

  3. You must read, accept and sign the Terms and Conditions when provided prior to departure.

  4. You must read, accept and sign the Assumption of Risk and Indemnity - Release and Waiver when provided prior to departure.


RELEASE OF LIABILITY

Ultimate Cape Escape, its Agents, Assigns and Contractors accept no responsibility for and shall not be liable in respect of any loss, damage, alterations, delays or changes arising from circumstance outside its or its Contractors’ control, such as, but not solely, war or threat of war, riot, industrial dispute, civil strife, fire, adverse weather conditions, terrorist activity, natural and nuclear disaster, technical transport problems, computer malfunction, cancellation of scheduled or charter airlines, closure or congestion of airports or ports, or financial failure of Contractors or departments.
